Terms and Conditions

Rules for using WakeAt

Effective September 17, 2026.

Before relying on the alarm

WakeAt is a travel aid: GPS, the operating system, volume, battery and map services may be unavailable. Set a cautious margin and a time fallback; do not use it as an emergency system or your sole protection against serious harm.

1. Provider and contact

WakeAt is personally maintained by Paolo Racca, an individual in Italy, as a currently non-commercial personal project. Legal, privacy and security contact: wakeat@proton.me. These Terms govern the WakeAt Android app and its landing page. The Privacy Policy explains the handling of personal data.

2. Acceptance, capacity and consumers

By installing, accessing or using WakeAt, you accept these Terms. If you do not accept them, do not use the service. You must have the legal capacity required in your country; minors must use the app with a parent or guardian involved. Nothing limits mandatory consumer rights or remedies.

3. Service description

WakeAt is a proximity alarm with a client-only core. After an explicit user command, the app checks location against a destination locally, displays a persistent notification and may trigger sound, vibration, an urgent notification, a GPS-loss timer and a wake deadline. It provides address search, map selection, configurable quick destinations, named routes, a widget, diagnostics, reports with notes and manual export. Reliability checks are displayed at start when they detect a problem or warning.

A saved destination, distance calculation and alarm are designed to work without a WakeAt backend; maps, search and reverse geocoding may require connectivity and external providers. Some secondary features may be absent or change during beta.

4. Essential limitations and safe use

WakeAt is not an emergency service, medical device, personal safety system, certified navigation tool or guarantee that you will wake up. GPS accuracy, tunnels, process termination, reboot, permissions, volume, Do Not Disturb, headphones, Bluetooth, battery, connectivity, Android changes and manufacturer restrictions may make an alarm early, late or unavailable.

The reliability check only reflects states Android allows the app to detect at that time: even an all-green result does not guarantee later operation. The dynamic timer uses distance and average speed to produce a cautious local estimate; it is not an arrival time and may fall back to the fixed timer when data is insufficient.

Before resting, check the destination, radius, fallbacks, volume and notification, keep the device charged and choose appropriate margins. Keep an alternative and do not rely solely on WakeAt where a missed alert could cause danger, missed care, legal consequences or material financial loss.

5. Permissions and background operation

The core feature requires approximate or precise location. WakeAt does not request background location permission: during a user-started trip, monitoring continues with the screen off or app not visible through a foreground service and persistent notification. Notifications, exact alarms, full-screen intents, vibration and audio depend on Android and device settings. You may refuse or revoke permissions, but features may become unavailable or degraded, and Android may replace a full-screen alert with an ordinary notification.

6. Acceptable use and user responsibility

You must use WakeAt lawfully and respect others’ rights. You may not interfere with the app, network, maps or providers; attempt unauthorised access; perform bulk scraping; circumvent technical limits; distribute malware; or reverse engineer beyond rights that applicable law makes non-waivable. You are responsible for your destinations, notes, exports and settings. Notes are free text and reports may include destination names and technical context: you must review the CSV and deliberately choose its recipient before sharing.

7. Maps, geocoding and third-party services

Rendering uses MapLibre Native. Styles and tiles are provided by OpenFreeMap, operated by Hyperknot Software Kft., through infrastructure that may include Cloudflare. Map data includes OpenStreetMap © OpenStreetMap contributors, available under the ODbL. Search uses the public Photon instance, operated by komoot GmbH, at photon.komoot.io; the service processes the search text and, when results are sparse, may receive up to two query variants and be supplemented by the Geocoder installed on the device. Languages unsupported by the instance, currently including Italian, use the provider’s default local-language mode. Reverse geocoding uses the Geocoder.

The OpenFreeMap terms, its privacy policy, the public Photon service terms, komoot’s general privacy policy, the Cloudflare privacy policy and the OpenStreetMap terms also apply. Photon is offered without an SLA for reasonable use and may throttle extensive requests; WakeAt does not control provider logs. These providers are independent, may change or discontinue their services, and WakeAt does not control their accuracy or availability.

8. Open-source software and attribution

MapLibre Native is distributed under the BSD 2-Clause licence. AndroidX, Jetpack Compose, Kotlin, kotlinx.coroutines, Gson, OkHttp, Okio, Timber and other components are distributed under their respective open-source licences, mainly Apache License 2.0. Their original licences prevail over these Terms for those components.

Full references: MapLibre licence, native component notices, Apache License 2.0 and OpenStreetMap ODbL/attribution. The app provides an “Open-source licences” section with release versions and notices.

9. Intellectual property and licence to use

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use WakeAt under these Terms. The name, logo, UI, documentation and non-open-source code remain protected and belong to their respective owners. No rights are transferred except those expressly granted.

10. Availability, updates and termination

WakeAt is currently an MVP undergoing field testing. We may fix, update, change, suspend or discontinue features for security, compliance, sustainability or technical evolution. No update will introduce a charge without notice and consent where required. You may stop by uninstalling the app; we may restrict access for abuse, subject to applicable law.

11. Warranties

To the extent permitted by law, WakeAt and third-party content are provided “as is” and “as available”, without warranties beyond mandatory ones. We do not warrant continuous location accuracy, map availability, compatibility with every device, error-free operation or alarm delivery in every condition.

12. Liability

Nothing excludes or limits liability that the law does not allow to be excluded, including, where applicable, fraud, gross negligence, death or personal injury and mandatory consumer remedies. Otherwise, and to the extent permitted, we are not liable for missed stops or connections, transport costs, data loss or indirect losses caused by matters outside reasonable control or use contrary to app warnings and instructions.

13. Changes to these Terms

We may update these Terms for legal, technical or product changes. Material changes will be notified in the app or on the site before taking effect where reasonably possible. Continued use after that date constitutes acceptance where permitted; otherwise you may stop using and uninstall WakeAt.

14. Governing law and disputes

Italian law applies without depriving consumers of mandatory protections in their country of residence. Consumers may bring claims before the courts designated by mandatory law. Before starting a dispute, contact wakeat@proton.me so we can try to resolve the concern amicably.

15. Language and severability

The Italian and English versions are intended to have the same meaning; where a controlling version may lawfully be chosen, the Italian text controls. If a provision is invalid, the remaining provisions remain effective. Failure to enforce a right is not a waiver.
